Terms and Conditions of Enrolment, Participation and Use of Services

These Terms and Conditions (“Terms”) govern the access to and use of all educational programmes, training services, events, workshops, webinars, online platforms, digital resources, consultations, assessments, professional designations, memberships, coaching services, learning management systems, websites, communications and related offerings (“Services”) provided by the School for the Art & Science of Event Management (“the School”), a division of Conference Consultancy South Africa (Pty) Ltd (“ConfSA”, “we”, “us”, or “our”).

These Terms apply to all candidates, learners, students, delegates, attendees, clients, sponsors, partners, users and visitors (“you”, “your”, “Candidate”, or “Learner”), whether participating within the Republic of South Africa or internationally.

By registering for, accessing, participating in, purchasing, or using any Service provided by the School, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

 

1. Legal Capacity and Acceptance
 

1.1 By accessing or using the Services, you confirm that:

  • you are at least eighteen (18) years of age or have the consent of a parent or legal guardian;

  • you possess the legal authority and capacity to enter into a binding agreement;

  • all information supplied by you is accurate, current and complete; and

  • you agree to comply with all applicable laws and regulations.

1.2 If you do not agree to these Terms, you may not access or use the Services.

1.3 These Terms constitute a legally binding agreement between you and the School.

 

2. Scope of Services
 

2.1 The School provides professional education, training, certification preparation, workshops, masterclasses, online learning, professional development activities, assessments, event management consulting, digital learning resources and related services.

2.2 The School reserves the right, in its sole discretion, to amend, suspend, discontinue, substitute, reschedule or modify any aspect of the Services at any time without prior notice, including but not limited to:

  • programme content;

  • faculty or speakers;

  • schedules or dates;

  • delivery methods;

  • venues or platforms;

  • learning outcomes;

  • assessment methodologies;

  • technology platforms;

  • pricing;

  • certification requirements; and

  • programme structures.

2.3 The School does not guarantee that any programme, designation, certificate or course will satisfy regulatory, statutory, academic, employment, immigration, licensing or professional body requirements in any jurisdiction.

 

3. Nature of Certification and Designations
 

3.1 Certificates, designations, transcripts, statements of completion and digital credentials issued by the School represent private professional recognition conferred by the School.

3.2 Unless explicitly stated otherwise in writing, no programme, certification, designation or credential issued by the School:

  • constitutes a qualification registered on the South African National Qualifications Framework (“NQF”);

  • constitutes a qualification recognised by the South African Qualifications Authority (“SAQA”);

  • constitutes a professional designation registered in terms of South African legislation; or

  • guarantees professional registration, employment, advancement or income.

3.3 The School reserves the sole right to determine:

  • eligibility requirements;

  • assessment criteria;

  • academic standards;

  • conferral requirements;

  • disciplinary outcomes; and

  • continued use of any designation or credential.

3.4 The School may revoke, suspend or refuse any credential, designation, transcript, certificate or statement of achievement where:

  • academic dishonesty is identified;

  • misconduct occurs;

  • fees remain outstanding;

  • information supplied by the Candidate is inaccurate or misleading; or

  • the School determines, in its sole discretion, that continued conferral may prejudice the School, its affiliates, stakeholders, reputation or operations.

4. Registration and Admission
 

4.1 Submission of an application does not guarantee admission.

4.2 The School reserves the right to:

  • accept or reject applications at its sole discretion;

  • impose additional admission requirements;

  • request supporting documentation;

  • conduct interviews or assessments; and

  • limit enrolment capacity.

4.3 Candidates remain responsible for ensuring that they meet all technical, language, financial, scheduling and participation requirements.

4.4 The School reserves the right to deny admission or continued participation where conduct, behaviour, communication or actions may reasonably be considered disruptive, harmful, unethical, unlawful or inconsistent with the School’s values, operational requirements or reputation.

 

5. Fees, Payments and Financial Obligations
 

5.1 All fees are payable in the currency specified by the School.

5.2 Unless otherwise agreed in writing, all invoices are due immediately upon presentation.

5.3 The School may utilise third-party payment processors. The School shall not be liable for any losses, breaches, delays or damages arising from third-party payment systems.

5.4 Outstanding amounts may result in:

  • suspension of access to programmes or systems;

  • withholding of certificates, transcripts, designations or academic records;

  • cancellation of enrolment;

  • denial of access to assessments or events; and/or

  • referral for debt collection or legal proceedings.

5.5 The Candidate shall remain liable for all collection costs, tracing fees, legal costs on an attorney-and-client scale, interest and administrative charges arising from overdue accounts.

5.6 The School may charge interest on overdue accounts at the maximum rate permitted under applicable South African law.

5.7 Where scholarships, sponsorships, bursaries or subsidised placements are awarded, additional terms and performance obligations may apply.

5.8 The School reserves the right to recover losses, wasted costs or damages resulting from:

  • withdrawal after sponsored admission;

  • non-participation;

  • misrepresentation;

  • breach of agreements;

  • misconduct; or

  • failure to meet reasonable participation requirements.

6. Refunds and Withdrawal
 

6.1 Except where required by law, all fees paid are non-refundable.

6.2 Requests for refunds, credits or transfers must be submitted in writing.

6.3 Any refund, credit or transfer granted shall remain entirely at the School’s sole discretion.

6.4 Administrative fees, payment processing charges, foreign exchange losses, bank charges and third-party platform fees may be deducted from any approved refund.

6.5 No refunds shall be granted for:

  • partial attendance;

  • failure to participate;

  • missed sessions;

  • technological failures on the Candidate’s side;

  • dissatisfaction based on subjective preference;

  • removal for misconduct;

  • failure to complete assessments;

  • time zone conflicts;

  • internet access limitations; or

  • failure to read programme information.

6.6 Where a programme is cancelled entirely by the School prior to commencement and no suitable alternative is offered, the School may, at its sole discretion, provide either:

  • a refund;

  • a credit; or

  • transfer to another programme.

6.7 Under no circumstances shall the School be liable for consequential losses including but not limited to:

  • travel costs;

  • accommodation;

  • visas;

  • loss of earnings;

  • technology purchases;

  • exchange rate losses;

  • data costs;

  • opportunity costs; or

  • any indirect or consequential damages.

7. Learning Platforms and Technology
 

7.1 Access to online systems, learning management platforms, digital resources and virtual environments is provided on an “as available” basis.

7.2 The School does not warrant uninterrupted or error-free access.

7.3 The Candidate remains solely responsible for ensuring access to:

  • stable internet connectivity;

  • compatible hardware and software;

  • power supply;

  • security systems;

  • updated browsers; and

  • telecommunications services.

7.4 The School shall not be liable for:

  • system outages;

  • cyber attacks;

  • platform interruptions;

  • software incompatibility;

  • data corruption;

  • bandwidth limitations;

  • third-party technology failures; or

  • loss of access caused by circumstances beyond its control.

7.5 The School reserves the right to suspend, restrict or terminate platform access where misuse, security concerns or breaches of these Terms are identified.

 

8. Intellectual Property and Use Restrictions
 

8.1 All intellectual property rights relating to the Services remain the exclusive property of the School, ConfSA and/or their licensors.

8.2 This includes but is not limited to:

  • course materials;

  • templates;

  • methodologies;

  • recordings;

  • frameworks;

  • assessments;

  • presentations;

  • videos;

  • graphics;

  • branding;

  • programme structures;

  • Event Architecture™ methodologies;

  • trademarks;

  • logos;

  • digital resources; and

  • all related proprietary materials.

8.3 Participation grants a limited, revocable, non-exclusive, non-transferable licence for personal educational use only.

8.4 Unless expressly authorised in writing, you may not:

  • reproduce;

  • distribute;

  • republish;

  • adapt;

  • modify;

  • commercialise;

  • teach from;

  • resell;

  • record;

  • livestream;

  • scrape;

  • reverse engineer;

  • share login credentials;

  • use artificial intelligence systems to extract proprietary content for commercial use; or

  • create derivative works based on School materials.

8.5 Unauthorised use may result in:

  • immediate removal;

  • legal proceedings;

  • claims for damages;

  • revocation of credentials; and/or

  • criminal prosecution where applicable.

9. Recordings, Media Release and Use of Likeness
 

9.1 By participating in any programme, webinar, class, assessment, event, workshop or activity, you irrevocably consent to the recording, photographing, livestreaming and use of your image, voice, likeness, statements, contributions and participation.

9.2 The School may use such recordings and materials globally, in perpetuity and without compensation for:

  • educational purposes;

  • quality assurance;

  • promotional activities;

  • marketing;

  • reporting;

  • social media;

  • publications;

  • archival purposes; and

  • commercial purposes.

9.3 You waive any claims relating to privacy, publicity rights, copyright, compensation or approval in relation to such use.

 

10. Confidentiality and Peer Engagement
 

10.1 Candidates acknowledge that programmes may involve discussion of personal, organisational or commercially sensitive information.

10.2 Participants agree to maintain confidentiality regarding:

  • peer discussions;

  • shared experiences;

  • proprietary business information;

  • assessments;

  • faculty guidance; and

  • internal programme communications.

10.3 The School cannot guarantee confidentiality among participants and accepts no liability for disclosures made by third parties.

 

11. Academic Integrity and Conduct
 

11.1 The School maintains a zero-tolerance approach toward academic dishonesty and misconduct.

11.2 Prohibited conduct includes but is not limited to:

  • plagiarism;

  • cheating;

  • impersonation;

  • collusion;

  • falsification of records;

  • misuse of artificial intelligence tools contrary to assessment rules;

  • harassment;

  • abusive conduct;

  • discrimination;

  • disruptive behaviour;

  • intimidation;

  • unlawful conduct; and

  • reputational harm directed at the School or its stakeholders.

11.3 The School reserves the right to investigate any alleged misconduct and to impose sanctions including:

  • warnings;

  • removal from programmes;

  • cancellation of results;

  • withholding or revocation of credentials and or designations;

  • suspension;

  • permanent exclusion; and/or

  • legal action.

11.4 Decisions relating to academic integrity and conduct remain final and binding.

 

12. Assessments and Completion Requirements
 

12.1 Candidates must comply with all programme requirements, deadlines, attendance expectations and assessment criteria.

12.2 The School reserves the right to:

  • amend assessment methodologies;

  • moderate results;

  • adjust grading systems;

  • require reassessments;

  • impose progression rules; and

  • determine completion outcomes.

12.3 The School does not guarantee successful completion.

12.4 Failure to complete programme requirements within the prescribed period may result in:

  • forfeiture of participation;

  • an incomplete status;

  • removal from the programme;

  • additional fees; or

  • re-enrolment requirements.

12.5 Extension requests may be considered solely at the School’s discretion and may attract additional fees.

 

13. Professional Behaviour and Community Standards
 

13.1 All participants are expected to engage respectfully and professionally.

13.2 The School reserves the right to remove any participant whose conduct may reasonably be considered:

  • abusive;

  • threatening;

  • defamatory;

  • discriminatory;

  • disruptive;

  • unethical;

  • inappropriate; or

  • harmful to the learning environment.

13.3 No refund or compensation shall arise from removal based on misconduct.

 

14. International Participation
 

14.1 International participants remain responsible for compliance with all laws, tax obligations, visa requirements and regulatory requirements applicable within their jurisdictions.

14.2 The School makes no warranties regarding recognition, enforceability or acceptance of any credential outside South Africa.

14.3 The Candidate assumes all risks associated with cross-border participation, technology access, taxation and regulatory compliance.

 

15. Privacy and Data Protection
 

15.1 Personal information shall be processed in accordance with applicable laws, including the Protection of Personal Information Act, 2013 (“POPIA”), where applicable.

15.2 By engaging with the Services, you consent to the collection, processing, storage and sharing of information reasonably necessary for:

  • programme administration;

  • certification;

  • quality assurance;

  • reporting;

  • communication;

  • analytics;

  • security;

  • sponsorship reporting where applicable; and

  • operational purposes.

15.3 The School may share information with:

  • faculty;

  • moderators;

  • technology providers;

  • payment processors;

  • sponsors;

  • scholarship funders;

  • accreditation partners; and

  • professional service providers where reasonably necessary.

15.4 The School shall not be liable for unauthorised third-party access arising from cybercrime, force majeure events or circumstances beyond its reasonable control.

 

16. Third-Party Platforms and External Links
 

16.1 The Services may include access to third-party websites, applications, tools or platforms.

16.2 The School exercises no control over such third parties and accepts no responsibility for:

  • their availability;

  • security;

  • privacy practices;

  • accuracy;

  • content; or

  • performance.

16.3 Use of third-party services remains entirely at your own risk.

 

17. Force Majeure
 

17.1 The School shall not be liable for any delay, interruption, cancellation, suspension or failure arising from circumstances beyond its reasonable control, including but not limited to:

  • natural disasters;

  • pandemics;

  • epidemics;

  • war;

  • civil unrest;

  • terrorism;

  • strikes;

  • governmental action;

  • utility failures;

  • cyber incidents;

  • platform outages;

  • transport disruptions; or

  • acts of God.

17.2 In such circumstances, the School may:

  • postpone;

  • substitute;

  • convert to virtual delivery;

  • reschedule;

  • suspend; or

  • cancel Services without liability.

18. Indemnity
 

18.1 You agree to indemnify, defend and hold harmless the School, ConfSA, their affiliates, directors, officers, shareholders, employees, faculty, contractors, consultants, agents, representatives and partners from and against any claims, liabilities, damages, losses, costs or expenses arising from:

  • your participation;

  • your conduct;

  • your breach of these Terms;

  • your misuse of the Services;

  • infringement of intellectual property rights;

  • reliance upon programme outcomes; or

  • any third-party claims associated with your actions.

 

19. Limitation of Liability
 

19.1 To the maximum extent permitted by law, the total liability of the School, ConfSA and their affiliates arising from any claim relating to the Services shall not exceed the amount actually paid by the Candidate to the School in relation to the specific Service giving rise to the claim.

19.2 Under no circumstances shall the School or its affiliates be liable for:

  • indirect damages;

  • consequential damages;

  • reputational harm;

  • business interruption;

  • loss of opportunity;

  • loss of profits;

  • emotional distress;

  • data loss;

  • travel losses;

  • accommodation losses;

  • economic losses; or

  • punitive damages.

19.3 Participation in any Service occurs entirely at the Candidate’s own risk.

 

20. Disclaimer
 

20.1 The Services are provided on an “as is” and “as available” basis.

20.2 The School makes no guarantees, representations or warranties regarding:

  • uninterrupted availability;

  • learning outcomes;

  • business success;

  • employment outcomes;

  • professional advancement;

  • examination success;

  • income generation;

  • industry recognition; or

  • fitness for any particular purpose.

20.3 Opinions expressed by faculty, speakers, guests or participants are their own and do not necessarily represent the views of the School.

 

21. Suspension and Termination
 

21.1 The School reserves the right to suspend or terminate access to any Service immediately and without prior notice where:

  • these Terms are breached;

  • misconduct occurs;

  • fees remain unpaid;

  • reputational harm may arise; or

  • continuation is considered inappropriate by the School.

21.2 Termination shall not affect any accrued rights or outstanding financial obligations.

 

22. Governing Law and Jurisdiction
 

22.1 These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

22.2 Any dispute arising from these Terms shall fall within the exclusive jurisdiction of the courts of South Africa.

22.3 The School reserves the right to institute proceedings in any competent court having jurisdiction.

 

23. Severability
 

23.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.

 

24. Non-Waiver
 

24.1 Failure by the School to enforce any right or provision shall not constitute a waiver of such right or provision.

 

25. Amendments
 

25.1 The School reserves the right to amend these Terms at any time.

25.2 Updated Terms become effective immediately upon publication or communication.

25.3 Continued participation following amendment constitutes acceptance of the revised Terms.

 

26. Entire Agreement
 

26.1 These Terms constitute the entire agreement between the parties relating to the Services and supersede all prior discussions, representations or agreements.
